PHASE I ENVIRONMENTAL SITE ASSESSMENTS – IS MY PROPERTY CONTAMINATED?

A Phase I Environmental Site Assessments (ESA) is a report prepared for a real estate holding which identifies potential or existing environmental contamination liabilities.

The analysis, often called an ESA, typically addresses both the underlying land as well as physical improvements to the property.  ESAs provide liability protection to landowners under CERCLA (“Superfund”) law.

The process is defined by the American Standards for Testing and Materials (ASTM).  Avant has staff who have prepared ESAs for over 20 years, one of whom has taught an upper-level college class on preparing ASTM ESAs.

PHASE II SITE ASSESSMENTS – DETERMINING THE EXTENT OF CONTAMINATION

If environmental contamination is discovered or suspected, a Phase II site assessment is often performed to determine the extent of contamination across the property.

Avant specializes in determining target compounds, sampling locations, sampling methods, decontamination, worker protection, and ensuring proper laboratory analyses are conducted.

The end product is an assessment that is legally-defensible and provides a clear picture of contamination without excessive sampling.

Avant staff have used drilling, excavating, coring, water sampling, well installations, magnetometers, and ground-penetrating radar to determine contamination extent.

REMEDIATION – MAKING YOUR PROPERTY CLEAN

Once the environmental contamination extent is determined, a remediation plan is typically prepared. It will include materials management plans, worker safety, proper handling and disposal of contaminated materials, and confirmation sampling procedures.

The remediation plan may be submitted as a Voluntary Cleanup Plan in order to obtain State regulatory approval of an otherwise unregulated project. The plan is then implemented to remove or treat contamination.

Avant staff have prepared and implemented dozens of remediation plans for soil, groundwater, and buildings contaminated with gasoline, solvents, pesticides, metals, PCBs, asbestos, and other contaminants using dig-and-haul, dig-and-treat on site, and in-place remediation using chemical oxidizers, bioremediation, and chemical reaction treatments.




REGULATORY COMPLIANCE AND PERMITTING– GETTING IT RIGHT

State and federal environmental regulatory programs affect all manner of activities. Personnel at Avant have worked with every environmental regulatory program and are familiar with the regulations and regulators, assuring you that your project will be implemented correctly and accurately.

We have permitted oil and gas activities, landfills, special waste management, stormwater, air emissions, mines, water discharges, asbestos removal, and other activities.

Avant personnel have prepared Engineered Design and Operation Plans, permit revisions, applications for Certificates of Designation through county planning departments, air permits through the Colorado Air Pollution Control Division, stormwater discharge permits, hazardous waste compliance, and related tasks.

We have prepared Permits by Rule for hazardous waste treatment, and spill prevention, control, and countermeasure plans. Avant has assisted with compliance with hazardous waste disposal and hazardous communication issues and permitting at active and abandoned coal and metal mines.

VOLUNTARY CLEANUP PLANS – PERPETUAL PROTECTION FROM REGULATORY ENFORCEMENT

Remediation of abandoned mine and successful Voluntary Cleanup

The Colorado Voluntary Cleanup and Redevelopment program was created by the state legislature and regulators to facilitate the redevelopment and transfer of contaminated properties.

The program provides timely (45-day) review of cleanup plans submitted by property owners. Cleanup decisions are based on existing standards and the proposed use of the property.

Avant employees have assisted various property owners apply for and receive approval for Voluntary Cleanup Plans.

Once implemented, the program in perpetuity protects the owner and all future owners from state or EPA enforcement regarding the contamination identified in the Voluntary Cleanup Plan.

ASBESTOS INSPECTIONS AND ABATEMENT MANAGEMENT – FINDING AND REMOVING ASBESTOS

Asbestos-containing building materials can create serious health concerns for property managers and owners. Avant will work with you to identify and characterize asbestos, protect the safety of building occupants and the public, and to reduce your costs for asbestos management.

We identify hazards, develop in-place management plans or abatement strategies, and oversee abatement. We explore alternatives for safely managing asbestos and lead hazards to minimize costs. Encapsulation alternatives are available — abatement is not always necessary.

As a broad-based environmental company, we can also manage proper handling and disposal of other hazardous building components including universal wastes including thermostats and lamps; lighting ballasts, and industrial residues such as lead or mercury.

Many hazardous materials projects require Health and Safety Plans to manage worker safety and protection.

Avant has hazardous materials managers who can prepare site-specific health and safety plans including relevant OSHA standards, personal protection equipment, monitoring methods, and chain-of-command structures.
